    New Nippon Wrongful Death Lawsuit Mentions Nippon’s “Run to Failure” Policy—Classic Hits 100.7 KLOG News

    Another wrongful death lawsuit has been filed against Nippon Dynawave in Longview, claiming the company had a policy to run equipment to failure and that warnings about the white liquor tank that failed were ignored before the May 26th disaster.

    KIRO 7 says the lawsuit was filed on behalf of Mackenzie Ammons, whose husband, Jared Ammons, was one of 11 people killed when the tank failed, releasing roughly 900,000 gallons of the hot, caustic substance.

    Mackenzie says Jared had gone to work early that morning because he wanted to make sure he could be home that afternoon for their unborn baby’s first ultrasound. When she heard about what happened, she attempted to contact her husband, but he never answered. Later, she got the heartbreaking news that he had been killed in the incident.

    KIRO 7 says Jared had previously mentioned safety concerns at the plant to his wife and was looking for another job, but it was difficult to find something that offered the same pay and schedule. The lawsuit points to inspections of the tank in 2025 and 2026 that allegedly warned it had deteriorated beyond minimum safety standards and had a high likelihood of failure.

    Mackenzie’s attorney alleges Nippon Dynawave chose to keep the tank in service despite those warnings, describing it as a “run to failure” policy.

    Mackenzie is now expecting the couple’s son, who she plans to name Ethan Jared Ammons. Her due date is Christmas Eve. The lawsuit seeks monetary damages and asks that safety problems at the mill be addressed.
